New EU Payments services Directive (PSD2) is entering into force

European Union has adopted a new directive on payment services (PSD2) to improve the existing rules of PSD1 and take new digital payment services into account. The requirements of the new EU Directive (PSD2) on the commission applicable to payments in EU and European Economic Area (EEA) enters into force on January 13, 2018.

Find out what will be changed!

From now on the banks will be able to execute all the payments in EU and EEA, regardless of their currency, only with a charge option “SHA” or “shared” - applying charge option “OUR” will no longer be possible. This requirement applies to payments in any currency.

This means that, when executing a payment and paying the commission, the beneficiary bank will charge commission for the incoming payment and commissions of a corresponding bank, if any. As a result, there might be a situation that a smaller amount will appear on the receiver’s account than initially transferred. Exact expenses of all corresponding banks currently are not yet known. No changes will take place for the payments in EUR currency, already now they are executed only with the charge option “SHA”.

For the incoming money transfers from EU and EEA in the non-EU currencies, (USD, RUB, CHN, CAD, JPY, RUB, AUD etc.) the clients, who previously received money transfers with the charge option “Payer” or “OUR", from now on will receive the money as “SHA”, paying the commission for the incoming payment in accordance with the Bank’s price list.

Has the cost of any computer software acquired been treated correctly?

Risk Where a lump sum payment is made for the acquisition of a software licence, it will be accepted for tax purposes that the expenditure is revenue where the useful life of the software is expected to be less than two years. Where the expected useful life of the software is longer the correct tax treatment will depend on the circumstances, as set out in the explanation below. Mitigation Identify all payments for the acquisition of new software licences, and distinguish between regular periodical payments and lump sum payments. For any lump sum payments establish what the useful life of the software is expected to be for the business. For proprietors and partnerships where the expenditure is capitalised and the expected useful life is more than two years, any amortisation is not allowable as a revenue deduction, and a claim should be made for capital allowances. For companies the appropriate tax treatment will depend on the exact nature of the software involved. Effective from 6 ...

BREXIT AND VAT

The EVD has direct and over-riding effect on all EU Member States but local legislation is required because the EVD allows for countries to pick and choose certain rules. As a result, the local VAT rules across the EU are not always consistent. Why is this important when thinking about Brexit? It’s important because once the UK leaves the EU it will theoretically (but this is not certain) no longer be bound by the EVD. This means that the UK could have free reign to amend its VAT rules as it sees fit. For example, it would no longer be prevented from applying a reduced VAT rate on supplies of women’s sanitary products which is currently precluded under the EVD. Also, the rates of VAT applied to physical and digital newspapers and books (zero-rated and standard-rated respectively) could be harmonised without having to get the agreement of all 27 other EU Member States.
